Compliance Requirements for Cannabis Delivery Businesses
To operate a delivery-only cannabis retail business without a storefront, you may sell and deliver marijuana products directly to customers’ locations, provided you strictly adhere to legal regulations.
In California, the following rules apply:
Sales and deliveries are permitted only between 6:00 AM and 10:00 PM PST.
The recipient must present a valid government-issued ID confirming they are at least 21 years old for recreational marijuana or 18 years old for medical marijuana.
Cannabis products must be packaged in opaque, non-transparent containers to ensure discretion.
Deliveries must be carried out exclusively by employees of the licensed business.
Delivery drivers must be 21 years of age or older.
Delivery vehicles must not display any markings or signage that indicate they are transporting cannabis products.
All deliveries must be made to a physical residential or commercial address—no P.O. boxes or virtual addresses.
Retailers are required to have real-time tracking capability and must be able to immediately locate all delivery vehicles via GPS.
Product Carrying Limits:
Delivery drivers may carry up to $5,000 worth of cannabis products in their vehicle only if all products have been received and processed at the business’s physical location before departure.
If the orders have not been fully received and processed prior to departure, the driver is limited to carrying up to $3,000 worth of cannabis products.
